Terms of Service
These Terms of Service form an agreement between you and AppointFly, a software-as-a-service platform based in the United Kingdom.
These Terms of Service ("Terms") form an agreement between you and AppointFly ("AppointFly," "we," "us," or "our"), a software-as-a-service platform based in the United Kingdom. They cover your use of appointfly.com, our live previews, and the website design, online booking, and dashboard services we provide (together, the "Services").
By placing an order, paying a build fee, starting a subscription, or using the Services, you agree to these Terms. If you are agreeing on behalf of a business, you confirm that you have the authority to accept these Terms for that business.
1. The Services
AppointFly designs and builds a custom website for your salon, spa, or barbershop, with online booking and a management dashboard built in. Depending on your plan, the Services include hosting and site upkeep, online booking, client records, staff and schedule management, email and text reminders, online payments and deposits, coupons and promotions, reports, and support. The features included in each plan are listed on our Pricing page. We may improve and update the Services over time, but we will not remove a core feature of your plan without giving you notice.
The Services are intended for businesses. They are not offered to consumers for personal use.
2. Your account
You must be at least 18 years old and give us accurate information. You are responsible for keeping your login details secure and for all activity under your account, including actions taken by team members you add. Contact us right away at support@appointfly.com if you think someone has accessed your account without permission.
3. Payments and Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy from us, you also agree to Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Prices may be shown with sales tax or VAT added at checkout, as calculated by Paddle.
4. Fees
Build fee. A one-time fee covers designing, configuring, and launching your website. The amount is shown in your quote or at checkout. 50% of the build fee is due when you place your order, and the remaining 50% is due when you approve your website for launch.
Monthly plan. Your monthly subscription starts on the day your website launches. It keeps your website online, your booking system running, and support available. Subscriptions are billed monthly in advance and renew automatically until you cancel.
No commission. We never take a percentage of your bookings or sales. Within your plan's team member limit, you can add team members at no extra cost.
Domains. If you already own a domain, you keep it and we connect your website to it. If you ask us to register a new domain for you, it will be registered in your name, and any registration cost will be shown to you before purchase.
Payment processing for your clients. Deposits and payments that your clients make through your website are processed by Stripe through your own Stripe account. Stripe's processing fees are set by Stripe and paid by you. These payments go directly to you, not to AppointFly.
Failed payments. If a subscription payment fails, we will notify you and Paddle will try again. If the payment remains unpaid 14 days after the due date, we may suspend your website and dashboard until it is paid. Your data will not be deleted during a suspension.
Price changes. We will give you at least 30 days' notice by email before any change to your monthly plan price. The new price will apply from your next billing date after the notice period.
5. Refunds
Build fee. If you cancel your order before we begin design work, we will refund your build fee in full. Once design work has started, your build fee includes up to 3 rounds of design revisions. If you are still not satisfied with your design after 3 rounds and you decide not to launch, we will refund 50% of the build fee you have paid. After your website has launched, the build fee is non-refundable.
Monthly plan. If you are not happy with the Services, you can request a full refund of your first monthly payment within 14 days of your website's launch. After that, monthly payments are non-refundable, and we do not offer refunds for partial months.
To request a refund, email support@appointfly.com. Approved refunds are issued through Paddle to your original payment method. Nothing in this section affects any rights you have under applicable law.
6. Changing plans and cancelling
You can upgrade or downgrade your plan at any time. Upgrades take effect immediately, and Paddle will charge a prorated amount for the rest of your billing period. Downgrades take effect from your next billing date. Your website and data stay as they are.
You can cancel your subscription at any time from your dashboard or by emailing support@appointfly.com. There is no minimum term and no cancellation fee. Your cancellation takes effect at the end of your current billing period, and you will not be charged again.
When your subscription ends, your website and booking system go offline because they run on the AppointFly platform. Your domain stays yours, and you can export your full client list from your dashboard for 30 days after your subscription ends.
7. Ownership
Your content and data. You own your business name, brand, logo, photos, text, domain, client list, and booking data ("Your Content"). You give us a limited, non-exclusive licence to host, copy, display, and process Your Content only as needed to provide the Services.
Our platform. AppointFly owns the platform, booking system, dashboard, templates, software code, and all related technology and intellectual property. While your subscription is active, you have a non-exclusive, non-transferable right to use them for your business. You may not copy, resell, sublicense, reverse engineer, or use them to build a competing product.
Your website design. The custom design we create for you is licensed to you for use with the Services. If you cancel, we will, on request, return the content you provided (such as your logo, photos, and text) and give you images of your final website design. The underlying code and platform remain ours.
Portfolio. We may show your website in our portfolio and marketing. If you prefer that we do not, tell us in writing and we will remove it.
8. Your responsibilities
You agree that:
- You own or have permission to use all content you provide to us, and it does not infringe anyone else's rights.
- You will comply with all laws that apply to your business, including data protection, consumer protection, and marketing laws.
- You have a lawful basis, and consent where required, to collect your clients' information and to send them email and text reminders.
- You are responsible for your own services, prices, cancellation and no-show policies, and your relationship with your clients.
- You will not use the Services to send spam, upload harmful code, break the law, or harm anyone.
9. Data protection
When we process personal information about your clients and team members, you are the data controller and AppointFly is your data processor. In that role, we will:
- Process personal information only on your documented instructions and to provide the Services.
- Make sure our team is bound by confidentiality.
- Keep personal information secure using appropriate technical and organisational measures.
- Use only trusted sub-processors, as listed in our Privacy Policy, and give you notice before adding new ones.
- Help you respond to requests from individuals exercising their data protection rights.
- Notify you without undue delay if we become aware of a personal data breach affecting your data.
- Delete or return your data when your subscription ends, as described in our Privacy Policy.
- Give you the information you reasonably need to show compliance with data protection law.
We will never sell your clients' data or use it to market our own services to them. Our Privacy Policy explains how we handle personal information in more detail.
10. Support and availability
Every plan includes email and chat support. Growth and Pro plans receive priority support, and Pro plans include a dedicated point of contact. We aim to keep the Services available at all times, but there may be planned maintenance or outages outside our control. We will give notice of planned maintenance whenever we can.
11. Suspension and termination
We may suspend or end your access to the Services if you seriously or repeatedly breach these Terms, do not pay fees when due, or use the Services in a way that is unlawful or puts others at risk. Where reasonable, we will notify you first and give you a chance to fix the problem. If we end your access, you will still be able to export your client list for 30 days, unless the law prevents us from allowing this.
12. Disclaimers
The Services are provided "as is" and "as available." We work hard to help your business win more bookings, but we do not guarantee any particular number of bookings, amount of revenue, or search engine ranking. To the fullest extent permitted by law, we exclude all implied warranties, including warranties of satisfactory quality, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the fullest extent permitted by law:
- AppointFly will not be liable for any indirect or consequential loss, or for any loss of profits, revenue, bookings, goodwill, or data.
- Our total liability to you for all claims relating to the Services is limited to the total amount you paid us in the 12 months before the event that caused the claim.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by law.
14. Indemnity
You agree to compensate AppointFly for any claims, losses, or costs arising from Your Content, the services you provide to your clients, your dealings with your clients, or your breach of these Terms or the law.
15. Changes to these Terms
We may update these Terms from time to time. If we make significant changes, we will give you at least 30 days' notice by email or in your dashboard. If you continue to use the Services after the changes take effect, you accept the updated Terms. If you do not agree, you can cancel your subscription before they take effect.
16. Governing law and disputes
These Terms are governed by the laws of England and Wales. If a dispute arises, please contact us first at support@appointfly.com, and we will try to resolve it informally within 30 days. If we cannot resolve it, the courts of England and Wales will have exclusive jurisdiction, unless the law of the country where you are based gives you the right to bring a claim there.
17. General
These Terms, together with your order, our Privacy Policy, and our Cookie Policy, are the entire agreement between you and AppointFly. If any part of these Terms is found to be unenforceable, the rest will still apply. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these Terms without our written consent. We may transfer our rights and obligations if AppointFly is sold or reorganised, and we will notify you if this happens.
